Last Will and Testament

of Thomas Chace, Sr.

I, Thomas Chace, Sr. of Johnson County in the State of Kansas considering the uncertainty of this mortal life, and being of sound mind and memory, do make and publish this my last will and testament in manner and form following:

to wit:

I.

I hereby revoke all former wills made by me.

II.

I hereby direct my executor to pay all my just debts and my funeral expenses from my estate.

III.

I give and devise to my sons Elijah C. Chace and Thomas Chace Jr. of Johnson Co. in the State of Kansas, and to my daughter Eunice L. Angell of San Francisco in the State of California, each one undivided third interest in that piece of land situated in Johnson County in the State of Kansas and described as follows: the south east quarter of the north west quarter of section nine (9) township twelve (12) range twenty four (24) being forty acres, more or less.

IV.

I give and bequeath to my son Alonzo Chace of Spink County in the State of South Dakota, the sum of two hundred dollars ($200.00)

V.

I give and bequeath to my son Edward M. Chace of the City of Washington in the District of Columbia, the sum of three hundred ($300.00).

VI.

I give and bequeath to my son Albert H. Chace of the City of Washington in the District of Columbia, the sum of fifty dollars ($50.00).

VII.

I give and bequeath to my granddaughter Jennie B. Potter of the County of Johnson and State of Kansas, the sum of seventy five dollars ($75.00) and one share in the Friends College of the State of Kansas of the subscription value of twenty five dollars.

VIII.

I give and bequeath to my to my daughter Rebecca C. Potter of Johnson County in the State of Kansas all the residue of my estate with the full understanding that this with what she has already received is in full discharge of all claims she may have upon my estate.

IX.

In event that my estate shall become reduced from any cause whatsoever so as to be insufficient to meet the devise and bequests herewith laid upon it, I hereby direct my executor to give unto each of the individuals named herein as benefactories such a proportional part of the whole as he or she would have taken under this instrument provided my said estate had remained intact and I appoint Alonzo Chace executor hereof.

Be it remembered, That on the day of the date hereof, at a Regular Term of said County Court, pursuant to notice duly given, the Last Will and Testament of Thomas Chace late of the County of Johnson in the State of Kansas, deceased, bearing the date of 6th day of February 1893, and being the annexed written instrument, was duly proved before the County Court in and for the County of Spink, and State of South Dakota, aforesaid, and was duly allowed and admitted to probate by said Court, according to law as and for the Last Will and Testament of said Thomas Chace, deceased, which said Last Will and Testament and the examination taken thereon is filed and recorded in the records of this Court.

In Witness whereof, The Judge of the County Court of said County has hereunto set his hand and the seal of the said Court in the City of Redfield in said County, this 30th day of July A.D. 1896.
